it appears i now have an additional problem with my client.

client called for the claim form after the appeal win but didnt send it (I had advised her to) as she was waiting on wage slips and an eventual p60.

client was awarded dla following a tribunal but didnt claim tax credits until after the appeal win ( claim was made pre april this year).

how long should the backdate be in this case as I am quite confused by the part that covers this in the CPAG book (pg 1356) and the regs (reg 8 of the tax credits regs).

the main reason the regs are confusing me is the words benefit payable as i am getting myself in knots over this being the tax credits or the dla. However, your client will only meet this provision if the WTC entitlement throughout the backdating, depended on the qualifying disability benefit (i.e. If he would have been entitled to WTC regardless of the DLA award/ disability element, then the backdating is the normal 31 days.

He must also make the claim within 31 days of the date the DLA was determined in his favour, for this provision to apply.

But because of the huge delays and backlogs in the PIP system, many disabled people are having to wait months before a decision is made on their PIP claim.

I have had a look at reg 5 of the tax credits claims and notifications regs and it appears that she may have a case under (2)(b) to have it backdated. I think it unlikely that if he made a telephone call to the tax credit helpline requesting a form, that this would by itself, be accepted as a claim.
